Mazda argued claims of consumer fraud, breach of implied warranty and concealment should all be dismissed because the plaintiff failed to allege facts to satisfy the pleading requirements to establish any of the claims. The other problem is that the ticking has gotten quieter, so whatever it was, it probably got worn in. Was this any indication of your parts going bad? Left untreated these problems can lead to oil leaks, stretched out timing chains, and catastrophic engine failure.
